1. About Harmoni

Harmoni is a wellness observation platform operated by Harmoni Care Inc., an Alberta corporation. Harmoni uses Apple Watch data to provide gentle wellness observations to families caring for loved ones aging at home.

Important: Harmoni is a wellness tool, not a medical device. Harmoni does not diagnose, treat, or provide medical advice. It is not approved by Health Canada or the FDA. Harmoni observes and reports — it never interprets. Always consult a qualified healthcare provider for medical concerns. In an emergency, call 911.

2. Eligibility

You must be at least 18 years of age to create a Harmoni account. By using Harmoni, you confirm that you have the legal authority to agree to these terms.

Loved Ones (the person being cared for) can be any age. When a Loved One is unable to consent for themselves, the Family Admin must have legal authority to consent on their behalf.

3. Your Account

You are responsible for:

• Providing accurate, current information when creating your account
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately if you believe your account has been compromised

One account per person. Do not share your login with anyone else.

4. Care Circles

Harmoni operates through Care Circles — groups of people who collectively support a Loved One's wellbeing. By creating or joining a Care Circle, you agree to:

• Respect the privacy and dignity of the Loved One being cared for
• Use wellness data only for the purpose of care and support
• Not share wellness data outside the Care Circle without consent
• Act in good faith and in the best interest of the Loved One

Family Admins are responsible for managing Care Circle membership and access permissions.

5. What Harmoni Is Not

Harmoni is not:

• A medical device or diagnostic tool
• A substitute for professional medical advice, diagnosis, or treatment
• An emergency service — always call 911 for medical emergencies
• A guarantee that health events will be detected or prevented

Wellness scores are observations based on Apple Watch sensor data. They reflect patterns, not diagnoses. Data accuracy depends on proper Apple Watch wear and sensor performance.

6. Harmoni Visit (Caregiver Marketplace)

Harmoni Visit connects families with independent caregivers for in-home support. When you book through Harmoni Visit:

• Caregivers are independent contractors, not employees of Harmoni Care Inc.
• Harmoni facilitates the connection but does not directly provide care services
• A 25% platform commission is included in the rate shown at booking
• We verify caregiver credentials, but families should exercise their own judgement
• Harmoni is not liable for the quality, safety, or outcome of any visit

7. Subscriptions & Billing

Harmoni membership is offered per Loved One, per month:

• Essential: $99.99 CAD/month — manual vitals, logbook, medications, care circle
• Comprehensive: $149.99 CAD/month — everything, including Apple Watch scoring, alerts, and AI insights

For caregiving agencies (B2B), per-client monthly plans are available:

• Essentials: $89 CAD/client/month — core dashboard, family alerts, wellness score, 3-role access
• Professional: $129 CAD/client/month — full 6-role system, community nurse integration, medication tracking, shared Digital Log
• Enterprise: $179–199 CAD/client/month — white-label, API access, dedicated onboarding, multi-agency management

Payments are processed securely through Stripe. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months. If a free trial is offered, you will not be charged until the trial ends.

8. Acceptable Use

You agree not to:

• Use Harmoni for surveillance or to control another person
• Share access credentials with unauthorised individuals
• Attempt to access data outside your authorised Care Circle
• Reverse-engineer, decompile, or tamper with the Harmoni platform
• Use automated tools to scrape or extract data from Harmoni
• Misuse caregiver data obtained through Harmoni Visit
• Use Harmoni for any unlawful purpose

9. Intellectual Property

The Harmoni platform, including its design, scoring algorithms, and content, is owned by Harmoni Care Inc. and protected by intellectual property laws. You retain ownership of your personal data and wellness information.

By using Harmoni, you grant us a limited licence to process your data as described in our Privacy Policy. We do not claim ownership of your data.

10. Limitation of Liability

To the maximum extent permitted by law, Harmoni Care Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to:

• Medical decisions made based on wellness observations
• Missed or delayed notifications due to device or connectivity issues
• Actions or omissions of caregivers booked through Harmoni Visit
• Data loss or service interruptions

Harmoni is a wellness observation tool and should not be relied upon as the sole means of monitoring someone's health or safety.

11. Termination

Either party may terminate this agreement at any time. You can delete your account through the app or by contacting us. Upon termination:

• Your subscription will be cancelled at the end of the current billing period
• Your personal data will be deleted per our Privacy Policy retention schedule
• You can export your data before account deletion

We reserve the right to suspend or terminate accounts that violate these terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of Harmoni after changes constitutes acceptance of the updated terms.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta.
